Terms of Service & EULA

By downloading, installing, or using the Bloompair mobile application (“App”), you agree to be bound by these Terms of Service and End User License Agreement (collectively, the “Terms” or “EULA”). If you do not agree, do not use the App.

Subject to your compliance with these Terms, Bloompair grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the App on any Apple-branded device that you own or control, solely for your personal, non-commercial use. This license does not allow you to use the App on any device you do not own or control, and you may not distribute or make the App available over a network where it could be used by multiple devices at the same time.

Bloompair is a mobile application designed for expecting and new-parent couples to track daily health habits, share progress with a partner, send supportive nudges, and manage shared tasks. The App is available on iOS.

You must be at least 13 years of age to use Bloompair. By using the App, you represent that you meet this age requirement.

When you first open Bloompair, we create an anonymous account for you so you can try the App without providing an email or password. Anonymous accounts are subject to limits (one habit, one task, one appointment) and cannot receive push notifications. To remove these limits, save your progress across devices, and enable notifications, you may add an email and password from within the App. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Anonymous accounts that are never upgraded and never paired with a partner are automatically deleted after 30 days.

Bloompair offers a free tier with limited features and a Premium subscription with additional capabilities. Premium subscriptions are billed through the Apple App Store. One subscription covers both partners in a couple.

You may cancel your subscription at any time through your App Store settings. Cancellation takes effect at the end of the current billing period.

Bloompair allows you to pair with one partner using an invite code. By pairing, you consent to sharing certain data (habit progress, mood, tasks) with your partner as described in our Privacy Policy. You may unpair at any time from the App settings.

You agree not to:

• Use the App for any unlawful purpose
• Attempt to gain unauthorized access to other accounts
• Interfere with or disrupt the App or servers
• Transmit harmful code or content
• Use the App to harass, stalk, or harm another individual

All content, features, and functionality of Bloompair — including design, graphics, text, and software — are owned by Bloompair and protected by applicable intellectual property laws. You may not copy, modify, or distribute any part of the App without written permission.

Bloompair is a wellness and habit-tracking tool, not a medical device. The App does not provide medical advice, diagnosis, or treatment. Always consult your healthcare provider for medical decisions. Do not rely on Bloompair as a substitute for professional medical care.

The App is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. Bloompair does not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components. You use the App at your own risk.

To the fullest extent permitted by law, Bloompair shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App. Our total liability shall not exceed the amount you paid for Premium in the 12 months preceding the claim.

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from Settings. Upon termination, your data will be permanently deleted as described in our Privacy Policy.

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Continued use after changes constitutes acceptance.

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

You represent that you are not located in a country subject to a United States Government embargo, or that has been designated by the U.S. Government as a “terrorist-supporting” country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. You agree to comply with all applicable U.S. and international export laws and regulations when using the App.

The following terms apply when you download or use the App from the Apple App Store:

• These Terms are an agreement between you and Bloompair only, and not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content.
• The license granted in Section 2 is limited to a non-transferable license to use the App on an Apple-branded device that you own or control, and as permitted by the Usage Rules in the Apple Media Services Terms and Conditions.
• Apple has no obligation to furnish any maintenance or support services for the App.
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the App to you. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App, and any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty will be Bloompair’s sole responsibility.
• Bloompair, not Apple, is responsible for addressing any claims by you or a third party relating to the App or your use of the App, including (i) product liability claims, (ii) claims that the App fails to conform to any applicable legal or regulatory requirement, and (iii) claims arising under consumer protection, privacy, or similar legislation.
• In the event of a third-party claim that the App or your possession and use of the App infringes that third party’s intellectual property rights, Bloompair, not Apple, will be solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• You acknowledge that Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
